Intellectual Property and Takedown Policy

Purpose and scope

This Law Enforcement Playbook sets out the internal rules and procedures applied by the Platform for intellectual property protection, content control, takedown actions, and cooperation with authorities. It governs how the Platform detects, investigates, restricts, removes, and escalates content, listings, accounts, and activities that infringe intellectual property rights or violate applicable law. This document is operational in nature and does not create rights in favor of Vendors, Buyers, or third parties.

  1. Platform role and legal posture

The Platform operates solely as an intermediary marketplace. It is not the seller of record, not the publisher of Vendor content, and not the owner of products listed through Vendor eShops.

Enforcement actions described in this Playbook are taken to protect the Platform, comply with legal obligations, and mitigate risk. No enforcement action constitutes an admission of liability, knowledge, endorsement, or control over Vendor activity.

  1. Intellectual property subject matter

Intellectual property subject to enforcement under this Playbook includes, without limitation:

  1. Trademarks, trade names, logos, and branding elements.

  2. Copyrighted works, including images, videos, text, catalogs, and technical documentation.

  3. Patents, industrial designs, and registered or unregistered design rights.

  4. Digital assets such as CAD files, BIM models, 3D models, drawings, and specifications.

  5. Platform-owned software, databases, user interfaces, and system architecture.

  1. Prohibited conduct

The following conduct constitutes a violation subject to enforcement:

  1. Listing, offering, or selling counterfeit, pirated, or infringing products.

  2. Uploading content that infringes third-party intellectual property rights.

  3. Misuse of trademarks or branding in a manner that causes confusion or misrepresentation.

  4. Circumvention of technical protection measures or access controls.

  5. Repeated submission of false, misleading, or abusive intellectual property complaints.

  1. Detection and intake channels

Potential violations may be identified through:

  1. Automated monitoring and pattern detection.

  2. Manual review by Platform personnel.

  3. Complaints or notices submitted by rights holders or their authorized representatives.

  4. Regulatory or law enforcement notifications.

The Platform is not obligated to monitor all content proactively and may act only upon detection or notice.

  1. Notice and verification standards

Where a complaint is received, the Platform may require information sufficient to reasonably verify the claim, including:

  1. Identification of the allegedly infringing content or listing.

  2. Description of the intellectual property right claimed.

  3. Evidence of ownership or authorization to act on behalf of the rights holder.

  4. A statement of good faith belief that the use is unauthorized.

The Platform determines, in its sole discretion, whether information provided is sufficient.

  1. Takedown and restriction measures

Upon determining that a violation is suspected or confirmed, the Platform may, without prior notice:

  1. Remove or disable access to the relevant listing or content.

  2. Delist products from search, catalog, or visibility features.

  3. Restrict the affected eShop or account.

  4. Suspend or terminate Vendor or Buyer access.

  5. Withhold, delay, or reverse payments associated with the activity.

Measures may be temporary or permanent and may be applied cumulatively.

  1. Counternotice and review

The Platform may, but is not required to, allow a counter-notice or explanation from the affected party. Any review is discretionary, internal, and administrative. The Platform is not required to restore content or listings and is not obligated to adjudicate ownership disputes between third parties.

  1. Repeat infringement and escalation

Patterns of repeated infringement, abuse of the Platform, or high-risk behavior may result in:

  1. Permanent account termination.

  2. Blacklisting of associated entities, users, or payment instruments.

  3. Referral to law enforcement or regulatory authorities.

No warning is required before escalation.

  1. Law enforcement and regulatory cooperation

The Platform may preserve records, disclose information, and cooperate with competent authorities where required or deemed appropriate. Disclosure may occur without notice to affected users where legally permitted.

  1. No warranties and limitation

The Platform does not guarantee detection of all infringing activity and does not warrant uninterrupted availability of listings or content. Enforcement actions taken in good faith do not give rise to liability toward Vendors, Buyers, or third parties.
